These Terms and Conditions apply to all purchases and commissions made through this website. By placing an order or confirming a commission, you agree to the following terms: Commissioning a Painting
Deposit & Payment - Unless otherwise agreed a non-refundable deposit of one-third of the agreed commission price is required to confirm the commission. This secures the artist's time and resources for the project. - The balance is payable upon completion of the work, prior to delivery or collection. - Additional costs such as travel, accommodation (if required), and framing beyond standard options are not included in the commission price and will be quoted separately. Sittings & Availability - The client agrees to make themselves available for the sittings required to complete the commission to MJA's artistic standards. - If the client fails to attend scheduled sittings without prior notice, the deposit will be forfeited, and additional sittings may incur extra charges. - Changes to the agreed concept or additional sittings requested by the client may result in additional fees. Completion & Alterations - The final decision regarding the completion of the work rests with MJA, following consultation with the client. - Minor adjustments requested after completion may be accommodated at MJA’s discretion, while significant alterations may incur additional charges. Copyright & Usage - All artwork, including commissioned pieces, remains the intellectual property of MJA and is protected under UK and international copyright law. - The client is granted a non-exclusive, personal license to display the commissioned artwork for non-commercial purposes. - The reproduction, distribution, or publication of the artwork in any form, including but not limited to digital and print media, is strictly prohibited without prior written consent from MJA. - MJA reserves the right to display images of commissioned works in portfolios, exhibitions, and promotional materials unless otherwise agreed upon in writing. - For licensing inquiries or commercial usage requests, please contact MJA directly. Cancellations & Refunds
- Commissioned works are non-refundable once work has commenced. - If the client cancels before work begins, the deposit will not be refunded. - Refunds or adjustments will not be provided once the final work has been approved and delivered. Purchasing Artwork & Prints
UK Delivery - Prints and artwork are shipped via a tracked and signed-for service. - Orders are typically dispatched within 7 working days; however, during busy periods, this may extend to 14 days. Customers will be notified if delays are expected. - Once delivery is confirmed by the courier, responsibility for the order transfers to the recipient. International Delivery - International orders are shipped via tracked services, with estimated delivery times of 1 to 7 days depending on the destination. - Customers are responsible for any applicable customs duties or import taxes. Delays caused by customs clearance are beyond MJA's control. Payment & Order Confirmation - Upon placing an order, customers will receive an email confirmation with order details. - If there are any issues, such as delays or out-of-stock items, the customer will be contacted promptly. - Shipment notifications will include tracking details for the order. Returns & Damaged Items - All items are carefully inspected before dispatch. In the unlikely event of damage during transit, customers should contact MJA with their order details, a description of the damage, and photographic evidence to arrange a replacement or refund. - Returns are not accepted for undamaged goods due to the delicate handling required for artwork and prints. - MJA is committed to finding an equitable solution should the client be dissatisfied with their purchase; please reach out for assistance. Cancellation Rights - Orders can be cancelled before dispatch, but once shipped, cancellations are no longer possible. - Clients are advised to carefully inspect their order upon receipt. Framing - Standard framing is included in the cost of commissioned works unless otherwise stated. - Specific framing requests beyond standard options can be arranged at an additional cost. Travel & Additional Expenses - MJA is available for commissions within the UK and internationally. Travel and accommodation expenses (if applicable) will be quoted separately. - Any additional expenses related to completing the commission, such as hiring studio space outside MJA’s own studio, courier costs, or special materials, will be discussed and agreed upon in advance.
